RENTAL AGREEMENT, RELEASE AND ASSUMPTION OF RISKS

Delivery: To address specified by lessee (customer). Lessee grants right to enter said property for the delivery and pick-up of the unit at approximately specified times.
ASSUMPTION OF RISKS The lessee understands and acknowledges that the activity to be engaged in through my rental of interaction amusement game(s) and/or other amusement equipment such as jump houses, brings with it both known and unanticipated risks to it’s guests, it’s invitee and itself. Those risks include, but are not limited to falling, slipping, crashing and colliding which could result in injury, illness, disease, emotional distress, death and/or property damage to myself or my guests and invitee.
LIABILITY RELEASE The lessee voluntarily release, indemnifies and agrees to hold harmless and discharge AH SIR BOUNCE A LOT (hereinafter collectively referred to “ASBAL”), from any and all liability, claims, demand actions or rights of actions, whether personal to itself or to a third party which was related to, arise out of or are in any way connected with the rental of the interactive inflatable unit including those allegedly attributed to negligent acts or omissions. The Lessee agrees to reimburse any reasonable attorney’s fees and costs that may be incurred by ASBAL in the defense of any such liability claim, demand, action or cause of action.
In the event that the Lessee files a cause of action against ASBAL, the lessee agree to do so solely in the state of CALIFORNIA, and further agrees that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. The Lessee agrees that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
Lessee acknowledges and represents that is has adequate homeowner’s insurance, tenant insurance, or OTHER liability insurance to cover any bodily injury or property damage which might occur to itself, it’s guest or it’s invitee from the use of the unit being rented or else Lessee agrees to bear the costs of defense and liability of any such injury or damage itself. The Lessee waives the rights of its insurance company to bring any type of action or proceeding on behalf of the Lessee against ASBAL whether by assignment of claim, subornation or otherwise.
RULES Lessee agrees to supervise both the equipment and its use at all times said equipment is in the possession of the Lessee. Accompanying this contract is a set of directions fir use and safety rules that I agree to follow and utilize at all times during the operation and use if the interactive inflatable games.
SAFETY FIRST!
1. Do not allow children to enter the inflatable without ADULT supervision.
2. All riders must remove shoes, jewelry, eyeglasses, combs, hair clips or any other hard or
sharp objects that could cause injury to other children or the
unit itself, before entering.
3. When riders are in the bounce, there should be NO flips, wrestling, running, pushing,
climbing the net walls or any other aggressive behavior that could injure other children.
4. Do not let riders bounce against the sides or near the entrance.
5. Only children of compatible age and size should be in the unit at the same time. Mixing
children of different sizes will greatly increase the risk of injury.
**Absolutely NO Food, drink, gum or SILLY STRING inside or near the bounce house.
Cleaning fee of $1000.00 may be enforced.
